The following terms and conditions are legally binding when signed.
1. Course Requirements:
Summer Camp: YES USA sets 12 years old as the minimum age and 21 years old as the maximum age for program participation.
2. Course Availability:
Every attempt will be made to place you on the course of your choice. In the unlikely event of YES USA being unable to run your chosen course, you will be offered an alternative course/dates or a refund.
3. Payment:
3.1 25% deposit of the total fees must be paid at the time of booking to reserve the seat.
3.2 The remaining fees must be paid 90 days before the program start date.
3.3 Bookings made 90 days or less prior to the program start date require full course fees at the time of booking.
3.4 YES USA reserves the right to release the booking(s) without any further notice if the payment(s) above are not received within the above-mentioned deadlines.
4. Cancellation and Refund Policy:
4.1 If a student fails to get a visa to the United States, he/she will be given a full refund upon submission of proof of denial of the visa provided by the Embassy of the United States.
4.2. Students shall have the right to cancel the booking and receive a full refund less a $25 administrative fee if cancellation is notified before 90 days of arrival.
4.3. The students can cancel their admission in their sole discretion in which case they will be entitled to a refund, provided that YES USA reserves the right to retain the following amounts paid by the students canceling their admission:
4.3.1 25% of the package if cancellation is made less than 90 days before arrival.
4.3.2 50% of the package if cancellation is made less than 60 days before arrival.
4.3.3 100% of the package if cancellation is made less than 30 days before arrival.
4.4. YES USA shall have the right to determine conclusively whether and to what extent a particular refund request is eligible to be entertained.
4.5. For all cancellation or refund requests, the student or his/her parent/guardian/referral agent should notify YES USA in writing at info@yesusa.com at the earliest possible time. YES USA will process the refund requests within four (4) weeks of receipt.
5. Pre-Arrival Documents:
5.1 Each student accepted to participate in the program and their parents or guardians are required to sign and submit the forms below 90 days prior to the program. The YES USA Pre-Arrival Documents consist of all of the following documents, together:
5.2.1 YES USA Student Code of Conduct enumerating the YES USA policies and procedures.
5.2.2 YES USA Health Policy and Declaration.
5.2.3 YES USA COVID-19 Policies and Procedures.
5.2.4 YES USA Liability Release, Waiver, Discharge, and Covenant not to Sue.
5.2.5 YES USA Photographs, Digital Images, Videotapes, Recordings Release Form.
5.2.6 A passport-style photo in accordance with the requirements of our hosting institutions specified at this link https://jobs.yesusa.com/hiring-form/photo-requirements with some basic personal information.
5.3 The above-mentioned forms will be provided to students and parents/guardians after booking the program.
5.4 YES USA cannot accept any students whose parents/guardians have not signed all Pre-Arrival Documents.
6. Insurance:
It is mandatory for every student to have health insurance. Students, parents, or guardians who wish to book health insurance through YES USA must request it upon booking the program. The students desiring to have insurance coverage from the company of their own choice must send the proof to that effect before arrival.
7. Compliance with Laws:
7.1 Students shall comply with all rules, regulations, guidelines, orders, and/or policies regarding COVID-19. Without limiting the generality of the foregoing, students shall comply with:
7.1.1 all applicable rules, regulations, guidelines, orders, and/or recommendations developed and issued from time to time by the Centers for Disease Control & Prevention (CDC)
7.1.2 all applicable rules, regulations, guidelines, orders, and/or recommendations from the Governor of the State of New York/Miami,
7.1.3 all applicable rules, regulations, guidelines, orders, and/or recommendations from other federal, state, and local governments and administrative agencies and/or bodies, and
7.1.4 all applicable rules, regulations, guidelines, orders, and/or policies of the hosting institution (collectively, (7.1.1)-(7.1.4), the “COVID-19 Guidelines”).
8. Force Majeure:
Neither YES USA nor the student shall be liable in case of breach of this Agreement caused by an event beyond the reasonable control of the parties or an event of force majeure, including the COVID-19 pandemic. YES USA reserves the right to cancel or modify the program according to laws, regulations, and policies enforced.
9. Governing Law:
These terms and conditions shall be governed by the laws for the time being in force in the United States. All disputes arising therefrom shall exclusively be determined by an American-based arbitration. If such arbitration fails to resolve the dispute, the matter may be brought before an American court having competent territorial jurisdiction.
